PROF. DR. DR. KARSTEN FEHN worked in the higher federal police enforcement service before becoming a lawyer, and also investigated and prosecuted white-collar crime cases (product and brand piracy) as an in-house counsel at Bayer AG. In addition, he has regularly lectured at the former Police Academy and published on police and criminal law topics. He is also a member of the editorial board of the journal “Police & Scienc” (“Polizei & Wissenschaft”). As a professor of criminal law and public law as well as a specialist lawyer for criminal law and specialist lawyer for medical law, a certified defense lawyer for white-collar and criminal tax law (DSV e.V.) as well as a certified Healthcare Compliance Officer (Steinbeis+Hochschule) and Tax Compliance Officer (C.H.BECK), he also has the necessary legal expertise to deal with complex issues relevant to white-collar criminal law.
DR. DR. BERND JOSEF FEHN worked for many years at the Customs Criminal Investigation Office and for the Financial Control Agency of Undeclared Work and Unlawful Employment and was involved in the investigation and legal prosecution of criminal offenses before becoming a lawyer and tax consultant. This included, in particular, customs law, foreign trade law, social security law, criminal tax law and related general criminal offenses. He was for many years a permanent contributor to the correlating journal for customs and excise duties and has published extensively on police, criminal and (customs, tax, commercial and general) criminal law issues. He is a certified defense lawyer for white-collar criminal law and criminal tax law (DSV e.V.), Ambulatory Healthcare Consultant (CCI), Tax Compliance Officer (C.H. BECK), as well as a lecturer at the University for Police and Public Administration of the State of North Rhine-Westphalia, an associate member of the Institute for Police and Criminal Sciences there and Fellow of Tax & Legal Excellence (F.TLE)
Our approach to internal investigations is structured and adapted to the organization of the respective company and the specific facts of the case. If required, we work together with renowned ECONOMIC DETECTIVES and SECURITY AGENCIES and, if necessary, also support you with the help of experienced COMMUNICATIONS AGENCIES in any public relations work that may become necessary. This can be particularly important to avert the threat of damage to your image.
As a matter of principle, we conduct several initial meetings with a close circle of trusted people in order to determine the objective and scope of the internal investigation. Building on that, we develop an investigation strategy in which we identify the information required for the subsequent legal processing of the facts and agree on investigative approaches to obtain it.
In addition to the classic evaluation of file material, this includes conducting structured interviews, undercover investigations and other similar things. It goes without saying that we always work in accordance with the law and ensure that all the information we obtain can later be used in court. If necessary or desired, we also take care of involving the authorities and communicating with them. This may include the preparation of extensive criminal charges against unknown persons or suspects identified based on internal investigations who have caused damage to your company.
At the end of the internal investigation, we prepare an investigation report as required, which is tailored in terms of scope and content to the needs of the client, its intended purpose and the target group.
We adapt our personnel approach to the task at hand using our experienced lawyers and our cooperation partners and, in addition to criminal law and tax law aspects – depending on the client – we also focus on medical law or general civil law aspects. In addition, we also consider facts relevant to employment law and – if necessary – also handle employment law disputes arising from the findings.
However, we do not consider our assignment to be completed with the conclusion of the internal investigation, but – as already indicated – subsequently offer you the complete legal processing of the facts, i.e. in particular the criminal, civil, labor law and, if necessary, administrative or social law extrajudicial and judicial support.
Furthermore, we always focus on the question of which compliance measures can help to prevent similar incidents in the future and avert further damage to the company and its employees while the matter is being investigated. This is where the special expertise of Prof. Dr. Dr. Karsten Fehn as a certified healthcare compliance officer and tax compliance officer and of Dr. Dr. Bernd Josef Fehn as a tax compliance officer and consultant in the outpatient healthcare sector once again comes into play.
